1. WHO IS COLLECTING YOUR DATA

Jackson Lewis Controls is responsible for your personal data. When you share your personal information with us, you have a right to expect that information to be treated with total confidentiality. Therefore, it is our responsibility to manage your personal data that you provide to us with care and in accordance with all data protection legislation and industry best practice.

2. WHAT DATA IS BEING COLLECTED

Personal data, or personal information, means any information about an individual from which that person can be identified.

We may collect the following information:

  • First name and last name.

  • Date of Birth/ Age.

  • ID including passport, driving licence and proof of address.

  • Job title/ Position.

  • Demographic information such as home, work and delivery address.

  • Financial Data in order to process payments to you and to stay legally compliant with staff working within our organisation.

  • We may require medical information and next of kin to ensure that you adhere to our health and safety policy and so that you and others are not placed at any risk.

  • Details about transactions you have made previously with us including the payments to and from you along with other details of products and services you have purchased from us.

  • Other information relevant for us to complete our services to you.
  • 3. WHAT IS THE LEGAL BASIS FOR PROCESSING THE DATA?

    We need to request and retain information for the performance of the contract and terms and conditions that you have signed or to enable us to get to the contract signing phase.

    Whether you have supplied your personal details by phone, by email or in a letter, we will never use them without a lawful reason to do so. We will use your personal data for the purposes for which they were initially requested and as fully explained in this Privacy Policy.

    4. WILL THE DATA BE SHARED WITH ANY THIRD PARTIES?

    We will cooperate with all third parties to enforce their intellectual property or other rights. We will also cooperate with law enforcement requests from within or outside your country of residence. This may include disclosing your personal information to government or law enforcement agencies, or private parties, when we have a good faith belief that disclosure is required by law or when we, in our discretion, believe that disclosure is necessary to protect our legal rights, or those of third parties and/or to comply with a judicial proceeding, court order, fraud reduction or legal process served on us. In such cases, we may raise or waive any legal objection or right available to us. These uses of your data are in our legitimate interests of protecting our business security. We may also use your data and share it with recipients for the purpose of complying with our legal obligations.

    Any third party that communicates with you on our behalf must only do so for the purpose of carrying out the services agreed and not for the purpose of direct marketing their own products and services.     5. HOW WILL THE INFORMATION BE USED?

    We will only use your personal data when the law allows us to. Most commonly, we will use your personal data in the following circumstances:

  • All general communications.

  • To follow up on, your comments and questions, and otherwise provide customer service.

  • Sending you quotes, processing orders, notifying you of orders received, updating you on deliveries, despatched or products out of stock.

  • Internal record keeping.

  • Where we need to perform the contract we are about to enter into or have entered into with you.

  • Where we need to comply with a legal or regulatory obligation.
  • 6. HOW LONG WILL THE DATA BE STORED FOR?

    We will apply some judgment and apply different holding times for holding different types of personal data, all of which will adhere to the legal timeframes advised. Please refer to our contact details in section 8 if you wish to know how long we will be storing your data based on our policy’s and legal obligations as these can vary case by case.

    7. WHAT RIGHTS DO YOU HAVE?

    You have the right to request your personal data to be permanently deleted from our records and systems to avoid any further communication with you. Your request will always be considered in light of the legal bases that we hold, store and process your personal data and the purpose that we collected your data. Where the legal bases permits, we will carry out your instruction without undue delay. Please note, however, that where we have a legal or contractual obligation to hold your personal data, we may not be able to carry out your request, but we will explain this fully to you.     It is your responsibility to ensure that your personal data provided to us is accurate and up to date. You can update your personal contact details by contacting our office on 01959 540 561 and asking for Selina Downey who will be in charge of maintaining accurate records. You may also use this number if you need to update any other personal information.

    Under the General Data Protection Regulation 2018, you have the right to obtain confirmation as to whether personal data concerning you is being processed, and where that is the case, access to the personal data including the following information:

  • The purposes of the processing.

  • The categories of personal data held.

  • The right to data rectification, data erasure, or restriction of processing.

  • The recipients of categories of recipients to whom the personal data may be disclosed.

  • Period of time that the data will be retained stored or the criteria used to determine the period of storage.
  • We will respond to your Subject Access Request as soon as possible and, in any event, within the statutory 30 days. However, in the event that we need more information from you to verify your identity, which we must do to ensure we disclose your personal data to the right person, the 30 day response period will only commence from the time that we have validated your identity.
